Client Flyer on President Trump's H-1B Proclamation

The American Immigration Lawyers Association (AILA) has issued a client flyer on the recent Proclamation by President Trump that temporarily halts decisions on new H-1B petitions and bans entry of certain H-1B workers unless a $100,000 fee is paid. The Proclamation took effect September 21, 2025, at 12:01 a.m. EDT for 12 months (with the possibility of an extension).  Â

Importantly, while the language of the Proclamation appeared to apply to all H-1B workers who are outside of the United States on or after the effective date, the government has since provided guidance clarifying that it only applies to all new H-1B petitions filed on or after September 21, 2025.

Individuals for whom H-1B petitions were filed before September 21, 2025 are not affected, as well as H-1B extensions, amendments, and changes of employer petitions for those in H-1B status who remain in the United States.

That said, information provided by the government has been imprecise and many questions remain about how this will work and who is affected. This guidance will likely change as the government provides additional information in the next few weeks.
